FOREIGN NON-GOVERNMENTAL AID (NGO)

Receiving foreign non-governmental aid (NGO) program

  1. a) Order of implementation:

– Step 1: Hai Phong City People’s Committee assigns an unit or organization to be the owner of foreign non-governmental aid (FNG aid).

– Step 2: Hai Phong City People’s Committee makes a decision on the establishment of FNG Aid Preparation Committee (if necessary)

– Step 3: The FNG aid owner shall coordinate with the sponsors in organizing the formulation of program documents according to specified form.

– Step 4: Hai Phong Department of Planning and Investment conducts procedures for FNG aid receipt to submit to Hai Phong City People’s Committee.

  1. b) Method of implementation:

– Directly at Department of Receiving and returning results – Hai Phong Department of Planning and Investment, No. 01 Dinh Tien Hoang, Hong Bang District, Hai Phong City.

– Via the postal system.

  1. c) Documents:

– Request document for approval of:

+ FNG aid-approving agency, for aid under the approving competence of the Prime Minister.

+ FNG aid owners for FNG aid amounts under the approving competence of the People’s Committee of Hai Phong city.

– The sponsor’s document agreed with the contents of the FNG aid amount and notices or commitments to consider the FNG aid grant.

– Draft program documents (in both Vietnamese and foreign languages) and specific FNG aid agreement (if required to sign for replacement of program or project documents later).

– Copy of the operation registration certificate and/ or a copy of the legal document of the sponsor’s legal status. Copies should be consularly legalized to ensure the legality of the document.

  1. d) Number of documents:

– 08 sets of which at least 01 original set (for FNG aid amounts under approving competence of the Prime Minister).

– For cases under the approving competence of the People’s Committee of Hai Phong city: 04 sets including at least 01 original set.

  1. dd) Time limit for settlement:

The time limit for evaluation does not exceed 20 working days from the date of receipt of complete and valid dossiers.

  1. e) Implementing agencies:

– Competent agencies on decision: Hai Phong City People’s Committee.

– Agencies directly executing administrative procedures: Hai Phong Department of Planning and Investment

  1. g) Subjects in charge of administrative procedures:

– Organizations defined in Article 4 of the Regulation on management and use of foreign non-governmental aids, issued together with Decree 93/2009 / ND-CP of the Government dated October 22, 2009 and FNG aid amounts under request for reception:

+ Not under the approval authority of the Prime Minister under the provisions of Point a, Clause 1, Article 15 of the Regulation on management and use of foreign non-governmental aids, issued together with Decree 93/2009 / ND-CP of the Government dated October 22, 2009;

+ Used goods with a simple structure more than 80% of the new use value (certified by the sponsor) in the list approved by the Prime Minister stated in Item 2 Point a of Clause 1 Article 15 of the Regulation on management and use of foreign non-governmental aids, issued together with Decree 93/2009 / ND-CP of the Government dated October 22, 2009;

– Recipients are organizations established or issued business registration certificates by Hai Phong People’s Committee.

  1. h) Results of administrative procedures:

Hai Phong People’s Committee’s written approval of the receipt of foreign non-governmental aid.

– Decree No. 93/2009/ ND-CP dated October 22, 2009 of the Government on promulgating the Regulation on management and use of foreign non-governmental aids;

– Circular 07/2010/ TT-BKH dated March 30, 2010 of the Ministry of Planning and Investment on guiding the implementation of Decree No. 93/2009/ ND-CP of the Government dated October 22, 2009.

Receiving foreign non-governmental aid (FNG) in the form of non-project.

  1. a) Order of implementation:

– Step 4: Hai Phong Department of Planning and Investment conducts procedures for FNG aid receipt to submit to Hai Phong City People’s Committee.

– If the non-project aid is used means, the following documents are required:

+ The sponsors’s registration form or means ownership certificate;

+ Registration certificate of the competent agency of the sponsor country. In case of means with temporary import, re-export, there must be a registration certificate of a competent Vietnamese agency;

+ The document of assessment of means of transport is more than 80% of the new use value, certified by the competent testing organization of the sponsor country.

  1. d) Number of documents:

– 08 sets of which at least 01 original set (for FNG aid amounts under approving competence of the Prime Minister).

 – For cases under the approving competence of the People’s Committee of Hai Phong city: 04 sets including at least 01 original set.
